By accessing or using the Platform, you (“User” or “you”) agree to be bound by these Terms.

Platform: Refers to Spicespace’s website and mobile application, including all associated services.
User: Refers to any individual or entity accessing or using the Platform.
Seller: Refers to individuals or businesses listing products or services for sale on the Platform.
Buyer: Refers to individuals or businesses purchasing products or services on the Platform.
We, Us, and Our: Refer to Spicespace, its owners, operators, affiliates, and subsidiaries.
3. Eligibility
You must be at least 18 years old to use the Platform.
By using the Platform, you represent and warrant that you meet the eligibility requirements.
4. Account Registration
To access certain features of the Platform, you may be required to create an account.
You must provide accurate and complete information during registration and keep your account information updated.
You are responsible for maintaining the confidentiality of your account credentials, including your password.
You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate your account at our sole discretion for any violation of these Terms.
5. Services Provided
Spicespace provides a platform for aggregating, trading, and facilitating the buying and selling of agricultural products, particularly spices.
Additional services such as sorting, grading, packing, logistics, and consumable sales may be offered through partner service providers.
Users are responsible for ensuring that the products or services they list or purchase meet their specific needs, including quality and quantity.
6. Transactions and Fees
Spicespace charges a fixed service charge per transaction and may take a percentage-based commission for certain services, such as value-added processing, logistics, and packing.
Users are responsible for all applicable transaction fees, including but not limited to service charges, processing fees, and any additional costs related to third-party services.
We reserve the right to change our fees at any time, with notice provided on the Platform.
Spicespace is not responsible for resolving payment disputes between Buyers and Sellers.
7. No Liability for Transactions
Spicespace acts as a platform connecting users and facilitating transactions. We are not a party to any transactions between Users.
We are not responsible for the quality, safety, legality, or accuracy of any listings or for any disputes arising from transactions between Users.
8. No Warranties
The Platform is provided “as is” and “as available” without warranties of any kind, express or implied.
We do not warrant that the Platform will be uninterrupted or error-free, that defects will be corrected, or that the Platform is free of viruses or other harmful components.
9. Limitation of Liability
To the fullest extent permitted by law, Spicespace will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform.
Our total liability to you for any claim arising out of or relating to these Terms or the Platform, regardless of the form of action, will not exceed the greater of: (a) the amount you have paid us in the 12 months preceding the claim; or (b) Rs. 7,500.
10. Third-Party Services
We may use third-party service providers to offer certain services on the Platform.
We do not control or endorse these third-party services and are not responsible for their actions, omissions, or performance.
11. Indemnification
You agree to indemnify and hold harmless Spicespace, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including attorneys’ fees, arising out of or relating to your use of the Platform or your violation of these Terms.
12. No Guarantees on Pricing or Availability
We do not guarantee the pricing or availability of any products or services listed on the Platform.
All products and services are subject to availability, and prices may vary based on market conditions.
13. Dispute Resolution
Any dispute between Users, including Buyers and Sellers, must be resolved directly between the parties involved.
Spicespace will not mediate or resolve disputes, and we disclaim liability for any claims arising from such disputes.
14. Termination
We may terminate or suspend your access to the Platform at any time, for any reason, without notice or liability.
Upon termination, your right to use the Platform will cease immediately, but any provisions in these Terms intended to survive termination will continue to apply.
15. User Content
You are solely responsible for any content you post on the Platform (“User Content”).
You represent and warrant that you have all necessary rights to post your User Content and that it does not violate these Terms or any applicable laws.
We do not endorse or assume responsibility for any User Content and reserve the right to remove any content that violates our policies or is deemed inappropriate.
16. Intellectual Property
The Platform and all its content, including text, graphics, logos, images, and software, are the property of Spicespace and are protected by copyright and other intellectual property laws.
17. Governing Law and Jurisdiction
These Terms will be governed by and construed in accordance with the laws of the Republic of India.
Any legal action or proceeding arising out of or relating to these Terms or the Platform will be brought exclusively in the courts of Kerala, India.
18. Entire Agreement
These Terms constitute the entire agreement between you and Spicespace regarding your use of the Platform.
19. Amendments
We may modify these Terms at any time. Any changes will be posted on the Platform and will take effect on the date posted.
Your continued use of the Platform after changes to these Terms constitutes your acceptance of the revised Terms.
20. Waiver
Failure by Spicespace to enforce any provision of these Terms will not be considered a waiver of our rights to enforce that provision in the future.
21. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
